Agreement to Terms
By accessing or using Chorducate ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
Description of Service
Chorducate is a browser-based tool for creating, sharing, and discovering fretboard diagrams for guitar, bass, ukulele, and other stringed instruments. The Service includes:
- An infinite canvas whiteboard for creating diagrams
- Export functionality (PNG, SVG)
- Sharing and collaboration features
- A community discovery platform
- User accounts and profiles
User Accounts
Account Creation: To create and export diagrams, you must create a free account with a valid email address. You can explore the chord library and discover page without an account.
Account Security: You are responsible for maintaining the security of your account credentials. Notify us immediately if you suspect unauthorised access.
Account Termination: We may suspend or terminate accounts that violate these Terms. You may delete your account at any time through your account settings.
User Content
Ownership: You retain ownership of all content you create using the Service ("User Content"). By posting User Content publicly, you grant us a non-exclusive, worldwide, royalty-free licence to display and distribute that content within the Service.
Responsibility: You are solely responsible for your User Content. You represent that you have all necessary rights to post such content and that it does not infringe any third-party rights.
Public Content: Content you mark as public may be viewed by anyone and may appear in search results. You can change visibility settings at any time.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe the intellectual property rights of others (including posting copyrighted music notation without permission)
- Post content that is defamatory, obscene, hateful, or promotes violence
- Harass, abuse, or threaten other users
- Distribute spam, malware, or deceptive content
- Attempt to gain unauthorised access to the Service or other users' accounts
- Interfere with the proper functioning of the Service
- Use automated tools to scrape or extract data without permission
- Impersonate any person or entity
Violation of these rules may result in content removal and account suspension.
Intellectual Property
Our Rights: The Service, including its design, features, and code (excluding User Content), is owned by Chorducate and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
Feedback: If you provide feedback or suggestions, you grant us the right to use them without compensation or attribution.
Copyright and DMCA
We respect intellectual property rights. If you believe your copyrighted work has been posted on the Service without authorisation, please contact us at copyright@chorducate.com with:
- Identification of the copyrighted work
- Location of the infringing content on our Service
- Your contact information
- A statement that you have a good faith belief the use is not authorised
- A statement that your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner
We will investigate valid claims and remove infringing content where appropriate.
Payments and Donations
Free Tier: The core Service is provided free of charge. We may introduce paid features in the future.
Donations: Donations are voluntary and non-refundable. They help support development but do not entitle you to additional features or priority support.
Future Subscriptions: If we introduce paid subscriptions, separate terms will apply. You will have the option to continue using the free tier.
Third-Party Services
The Service integrates with third-party services (e.g., YouTube, Spotify embeds). Your use of such integrations is subject to the terms of those third parties. We are not responsible for third-party content or services.
Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not warrant that:
- The Service will be uninterrupted or error-free
- Defects will be corrected
- The Service is free of viruses or harmful components
- The Service will meet your specific requirements
Limitation of Liability
To the maximum extent permitted by law, Chorducate and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.
Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Chorducate from any claims, damages, or expenses arising from your use of the Service, your User Content, or your violation of these Terms.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the courts of England and Wales, except where prohibited by law.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
